Документ Interaction of international and domestic law: some reflections on the issue of compliance of Ukrainian law with the international legal obligations of Ukraine(Гельветика, 2022) Streltsova, Yevdokiia D.; Стрельцова, Євдокія ДжонівнаThe article proposes an analysis of some aspects of the problem of the international law impact on the domestic law of Ukraine. It is highlighted that in the Ukrainian legal doctrine the issue of interaction between international and domestic law has recently been studied in connection with the increasingly active accession of Ukraine to international and regional legal spaces, which requires the adoption of the domestic legislative and organizational measures to ensuring the effectiveness and observance of the provisions of international law. In this study, the emphasis was placed on the implementation of international legal norms in Ukraine and the compliance of Ukrainian law with international legal obligations, as well as the observance of terminological identity as a separate issue of interaction between an international treaty and the legislation of Ukraine. The article states that, according to the legislation of Ukraine, its change on the basis of international treaty obligations can occur solely as a result of the state's own actions, since this is within the competence of the sovereign. Therefore, the implementation of the norms of international law occurs either through the direct application of the relevant international legal norm sanctioned by the state, or by amending the legislation, or as a result of the so-called judicial implementation, when judicial practice adapts the law enforcement in accordance with international legal norms and standards. Based on the study of the provisions of some international treaties and the relevant domestic legislation, conclusions were drawn regarding the domestic implementation of international treaties of Ukraine: the article states that it is necessary here to take into account the peculiarities of the international legal obligations of the parties, which is reflected in the texts of the treaties themselves; an international treaty of Ukraine implemented into the legal system of Ukraine by amending or adopting new legislative acts shall not be applied simultaneously with the legislative act in which its norms are included; the implementation of the norms of an international treaty does not always require the preservation of the terminological identity of the international treaty and the corresponding act of national legislation, etc. The article concludes that, overall, the Ukrainian practice of harmonizing domestic law on the basis of international treaties is quite developed and diverse, but at the same time it is more spontaneous, intuitive than subject to certain rules or priorities. Nevertheless, the consistent desire to carry out its international legal obligations in terms of bringing the legislation in line with the requirements of international treaties allows us to state the openness and readiness of Ukraine for further integration into the universal and regional legal spaces.Документ International and national legal protection of the civilian population during an armed conflict: the example of Ukraine(2024) Streltsova, Yevdokiia D.; Streltsov, Yevgen L.; Стрельцова, Євдокія Джонівна; Стрельцов, Євген ЛьвовичThe protection of civilians is a basic ethical, strategic, and legal requirement for the international community and every democratic state, one of the key aspects of any military (combat) action. Such protection should not only be proclaimed, but also serve as a priority. If armed forces during armed conflicts rely on the foundation laid by international humanitarian law and adhere to civilised rules of military (combat) operations, then the damage caused to the civilian population can be minimised. This problem is also important in terms of the international and national legal protection of the civilian population during the international military conflict in Ukraine.Документ International Criminal Court: the history of the establishment and legal status(Гельветика, 2023) Streltsova, Yevdokiia D.; Стрельцова, Євдокія ДжонівнаIt is stated that mass destruction and death of civilians around the world, including such countries, as Afghanistan, Serbia, Syria, Kenya, Uganda, South Sudan, Ukraine, other countries indicate the need for a peaceful resolution of ethnic conflicts both within each country and in the international arena. Therefore, the international community has long been faced with the challenge of developing coordinated measures to create a mechanism for regulating international relations in order to prevent aggressive wars and create a comprehensive system of international security. In this regard, it is highlighted that the creation of International Criminal Court (ICC) was determined by the objective conditions for the development of international law and international relations, the need to search for coordinated actions of states in solving the most important international problems. The establishment and activities of the ICC indicate that the system of international organizations has been replenished with a new organization for maintaining international law and order, therefore the activities of the ICC are one of the striking examples of cooperation between states in the fight against crime. In this regard the study of the historical development of the ICC and the Rome Statute is relevant in theoretical and practical terms, accordingly, the primary purpose of the article was to identify legal and institutional basics of the establishment of the ICC and its legal status. The article states that the ICC became the first permanent body of international criminal justice, the statute of which reflected the experience of previous international criminal tribunals, in particular the Nuremberg Tribunal, the Tribunal for the former Yugoslavia, and the Rwanda Tribunal. The emphasis was placed on the number of new provisions that have become unique for the ICC, for example, on complementarity with national criminal justice systems, on the protection of victims and witnesses of international crimes, etc. It is primarily about procedural norms, while the addition of new norms of substantive law regarding the components of international crimes that fall under the jurisdiction of the ICC turned out to be a much more difficult task. It took 12 years to add the crime of aggression to the Rome Statute. In the future, it is possible to supplement the Statute with other international crimes, such as ecocide, but to achieve this goal, long-term and focused work of both states and intergovernmental and non-governmental organizations will be required. The article concludes that despite the fact that due to some circumstances the activities of the ICC cannot be considered ideal, legal standards in the field of criminal justice need improvement, yet the creation and operation of the ICC means a certain progress in legal regulation and coordination of cooperation in the fight against crime.Документ Main trends in the modern legal integration(Одеський національний університет імені І. It presents an overview of the challenges, changes, and perspectives concerning the ways for the legal integration. It is suggested that all this aspects relate to a «reset» of legal regulations, which is demonstrated through peculiarities of the development of national legal systems, the development and accomplishment of the ways of their convergence, improvement of the mechanisms of their interaction. In terms of the development of national legal systems it is stated that the basic trends have been shown up through the maintenance of basic rights and interests of an individual; through ensuring democratic principles, strengthening a leading role of private law tools, etc. As to the ways of the modern legal integration it occurs obvious that harmonization and its various forms and methods, acquisition of practices and principles of foreign national legal systems, the extension of national law over the territory of a foreign jurisdiction etc., contribute substantially to such integration. It is considered that the application or non-application of the principle Iura novit curia may be evaluated as a violation of the arbitral procedure, and consequently, risks of refusal recognition and enforcement of arbitral award by national court may arise. The analysis of the latest research and case law demonstrates that the way of application of Iura novit curia to arbitration depends on the applicable law to arbitration procedure and on judicial system of national court that is entitled to recognize the arbitral award.
