Підкреслюється важливість визначення основних принципів та керів‑ них ідей для регулювання такого складного та неоднозначного явища, як конституційний статус іноземців. Визначається різноманітність підходів до визначення основних принципів конституційно‑правового статусу іноземців найбільш відомими вітчизняними конституціо‑ налістами.uk
dc.description.abstractВ науке конституционного права особое значение занимают исследования в области правового статуса личности, и в частности – правового статуса иностранцев. Это объясняется тем, что с одной стороны, любое демократическое правовое государство должно создавать надлежащие условия для временного или постоянного проживания всех лиц на своей территории и обеспечивать действенный механизм реализации и защиты их прав и свобод, не‑ зависимо от субъективных факторов, а с другой – защищать свои внутренние суверенные интересы и интересы своих собственных граждан как лиц, которые имеют наиболее тесную связь с этим государством. Национальное законодательство, регулирующее принципы правового статуса иностранцев, в целом соответствует международным стандартам в этой области. Однако следует отметить, что перечень этих принципов и их содержательная характеристика требуют своего дальнейшего совершенствования и дополнения. Решение этих задач и стало целью проведенного научного исследования.uk
dc.description.abstractIn science of constitutional law the researches in the field of the legal status of the individual, and legal status of foreigners in particular have a special value. Due to the fact that on the one hand, a democratic legal state should create the right conditions for temporary or permanent residence of all persons within its territory and provide an effective mechanism for the implementation and protection of their rights and freedoms, regardless of the subjective factors, and on the other – to protect their domestic sovereign interests and the interests of its own citizens as individuals who have the closest relationship with the State. National legislation governing principles of the legal status of foreigners in general, consistent with international standards in this area. However, it should be noted that the list of these principles and their substantial characteristic require further improvement and additions. The purpose of the research is to solve these problems.uk
