Анотація
У статті здійснено ґрунтовний аналіз особливостей реалізації фундаментального принципу рівності всіх учасників адміністративного процесу перед законом і судом саме на початковій стадії відкриття провадження. Наведено негативні факти реалізації цього принципу під час дії воєнного стану та поширення спорів, пов’язаних із проходженням військової служби, зокрема: прояви надмірного формалізму судів під час вирішення питання про відкриття провадження (що підтверджується позицією ЄСПЛ та практикою Верховного Суду); дискримінація за категоріями справ, що проявляється в необґрунтованому затягуванні відкриття провадження (особливо у справах військовослужбовців); невизначеність законодавства щодо застосування строків звернення до суду для похідних позовних вимог і дискримінаційна вимога сплати судового збору військовослужбовцями у справах, пов’язаних із виконанням військового обов’язку (на прикладі відшкодування неотриманого речового забезпечення). Запропоновано шляхи розв’язання виявлених недоліків як на теоретичному, так і на практичному рівні.
The article provides a thorough analysis of the features of the implementation of the fundamental principle of equality of all participants in the administrative process before the law and the court at the initial stage of the initiation of proceedings. The legislative foundations of the principle of equality of all participants in the administrative process before the law and the court and separately the stage of the initiation of proceedings in the administrative process are studied. The judicial practice, including that of the Supreme Court, courts of appeal, courts of first instance and the Constitutional Court of Ukraine, which concerns the features of the implementation of the principle of equality of all participants in the administrative process before the law and the court at the stage of the initiation of proceedings is studied and analyzed. Negative facts of the implementation of this principle during martial law and the spread of disputes related to military service are presented, in particular: manifestations of excessive formalism of the courts when deciding on the issue of initiation of proceedings (which is confirmed by the position of the ECHR and the practice of the Supreme Court); discrimination by category of cases, which is manifested in unjustified delay in the initiation of proceedings (especially in cases of military personnel); uncertainty of the legislation regarding the application of deadlines for filing a lawsuit for derivative claims and the discriminatory requirement for payment of court fees by military personnel in cases related to the performance of military duty (for example, compensation for unreceived material support). Ways to resolve the identified shortcomings are proposed both at the theoretical and practical levels.
