Анотація
У статті здійснено критичний аналіз сучасних підходів до системи та класифікації суб’єктів адміністративного права, що представлені в навчально-методичній літературі. Наголошено, що ґрунтовні змістовні зміни адміністративного права як галузі національного права, які відбулися на матеріальному (об’єктивному) та світоглядному (суб’єктивному) рівнях в Україні, потребують інших підходів до визначення таких важливих галузевих інститутів і категорій, як адміністративна правосуб’єктність, адміністративно-правовий статус, компетенція, повноваження та суб’єкти адміністративного права. Зроблено висновок, що теорія адміністративного права з питань визначення системи суб’єктів адміністративного права чомусь загальмувала й не розвивається суттєво останнім часом, що негативно позначається на розвитку науки адміністративного права, національного законодавства, освітнього процесу в закладах вищої освіти юридичної спрямованості та на практиці діяльності суб’єктів публічного адміністрування й адміністративних судів. Перспективним бачиться розвиток не тільки теорії публічного адміністрування, принципів адміністративного права та публічно-сервісної складової діяльності владних суб’єктів, а й теорії суб’єктів адміністративного права, без якої неможливо побудувати цілісну й узгоджену між собою систему знань про адміністративне право та інші адміністративно-правові явища в Україні і світі.
The article provides a critical analysis of modern approaches to the system and classification of subjects of administrative law, presented in the educational and methodological literature. It is emphasized that the fundamental substantive changes in administrative law as a branch of national law, which have occurred at the material (objective) and ideological (subjective) levels in Ukraine, require other approaches to the definition of such important industry institutions and categories as administrative legal personality, administrative legal status, competence, powers and subjects of administrative law. It is established that most of the proposed classifications of subjects of administrative law are characterized by the following shortcomings: 1) have theoretical significance in a specific area of problems of the science of administrative law and process, but are devoid of practical significance; 2) have practical significance (for example, are used to solve practical problems), but give rise to contradictions at the general theoretical level; 3) are devoid of both theoretical and practical significance, but are used as a result of customs that have developed within the relevant scientific school or in the worldview of the older generation of administrativeists. It was found that the concept of “subjects of administrative law” is widely used in educational and methodological literature to explain to students the basics of administrative legal regulation, but in theory it has lost its methodological significance, and in practice it is almost not used to resolve administrative cases. That is, the institute of subjects of administrative law has turned exclusively into a tool of the educational process, losing the status of a scientific tool and tools of law enforcement activity. It is concluded that the theory of administrative law on the issues of determining the system of subjects of administrative law has somehow slowed down and has not developed significantly recently, which negatively affects the development of the science of administrative law, national legislation, the educational process in higher education institutions of a legal orientation and the practice of the activities of subjects of public administration and administrative courts. The development of not only the theory of public administration, the principles of administrative law, and the public service component of the activities of government entities is seen as promising, but also the development of the theory of administrative law entities, without which it is impossible to build a holistic and coherent system of knowledge about administrative law and other administrative legal phenomena in Ukraine and the world.
