Анотація
Стаття присвячена дослідженню особливостей юридичного мовлення в англосаксонській правовій системі (common law) в контексті глобалізації, цифровізації та міжкультурної комунікації. Проаналізовано специфіку лінгвістичних конструкцій, синтаксичних моделей та термінологічної варіативності, що притаманні правовим текстам англомовної традиції. Особливу увагу приділено формалізованій структурі юридичних документів, ролі прецеденту як джерела права та впливу історико-культурного контексту на мовні стратегії правової комунікації.
У дослідженні акцентовано увагу на викликах, що постають перед перекладачами та лінгвістами в умовах правової багатомовності, а також на потребі в міждисциплінарному підході до аналізу юридичного дискурсу. Розглянуто взаємозв’язок між розвитком штучного інтелекту та адаптацією юридичних текстів до машинного опрацювання, включно з концепцією «машинозчитуваного права».
Також розглянуто сучасні ініціативи щодо спрощення правової мови (plain legal English) як засіб забезпечення доступності правової інформації для широкої аудиторії. Вказано на важливість корпусного аналізу правових текстів, прагматичного виміру мовлення в судовому процесі та культурної адаптації юридичних понять.
Результати дослідження свідчать про необхідність інтеграції знань з лінгвістики, правознавства та цифрових технологій для формування ефективної та інклюзивної правової комунікації в системі common law.
This article explores the specific features of legal discourse within the Anglo-Saxon legal tradition (common law) in the context of globalization, digital transformation, and inter-cultural communication. The study focuses on the linguistic and syntactic characteristics of English legal texts, emphasizing their formalized structure, precedent-based origin, and the high level of terminological standardization. Particular attention is paid to the historical and cultural background that shapes legal language, as well as the challenges that arise when translating legal concepts across different legal systems. The research highlights the increasing influence of artificial intelligence on legal communication, with a special focus on the development of machine-readable law and neural legal models. The integration of computational linguistics and legal informatics is shown to be essential for accurate analysis and processing of complex legal documents. Furthermore, the article addresses the movement toward plain legal English as a means to enhance the accessibility of legal information to non-specialists and underrepresented social groups. Another key aspect discussed is the performative nature of legal language, which not only describes but also constitutes legal reality. The paper underscores the need for interdisciplinary approaches that combine legal theory, linguistics, translation studies, and digital technologies. By analyzing linguistic patterns, discourse strategies, and cross-cultural translation practices, the article contributes to the broader understanding of common law discourse in the 21st century.
