Анотація
Досліджено сучасний стан адміністративно-правового регулювання відносин щодо притягнення осіб до адміністративної відповідальності. Встановлено, що систематизація адміністративно-деліктного законодавства, яка відбулася ще за часів Радянського Союзу, не відповідає потребам сьогодення ні за формою, ні за структурою, ні за змістом. Здійснено критичний аналіз структури Кодексу України про адміністративні правопорушення (далі – КУпАП), на підставі чого було визначено три причини внесення змін до неї за останні тридцять п’ять років: а) вдосконалення термінології, що використовується в адміністративно-деліктному праві; б) виникнення у суспільстві протиправних діянь, які потребували застосування заходів адміністративної відповідальності, але не відповідали критеріям класифікації правопорушень у Особливій частині КУпАП, що були розроблені і запропоновані ще в радянські часи; в) безпідставне і науково необґрунтоване розширення переліку адміністративних стягнень. Детальному аналізу було піддано матеріальні і процесуальні норми чинного адміністративно-деліктного законодавства та запропоновано шляхи їх вирішення в сучасних умовах державотворення.
The study is focused on the current state of administrative and legal regulation of the relations of bringing persons to administrative responsibility. It has been established that the systematization of administrative and tort legislation, which took place back in the days of the Soviet Union, does not meet the needs of today, neither in form, nor in structure, nor in content. A critical analysis of the structure of the Code of Ukraine on Administrative Offenses was carried out, on the basis of which three reasons for making changes to it over the past thirty-five years were identified: a) improvement of the terminology used in administrative and tort law; b) the occurrence in society of illegal acts that require the application of measures of administrative responsibility, but did not meet the criteria for classifying offenses in the Special Part of the Code of Administrative Offenses, developed and proposed back in Soviet times; c) groundless and scientifically groundless expansion of the list of administrative penalties. It was found that the modern structure of the Special Part of the Code of Administrative Offenses is illogical: firstly, there is an uneven distribution of offenses among the chapters of the Special Part; secondly, there is no single criterion for classifying administrative offenses according to the chapters of the Special Part of the Code of Administrative Offenses. The importance of a clear allocation in the structure of the Code of Administrative Offenses of its material and procedural parts is emphasized because the codified act combines substantive and procedural norms, so there is a need for a structural separation of the normative legal act, considering this specificity. The substantive norms of the current administrative and tort legislation were subjected to a detailed analysis. It has been established that the material part of the Code of Administrative Offenses has many shortcomings, one of which is the uncertainty with the meaningful correlation of the concepts of «administrative coercion measures», «administrative responsibility measures» and «administrative sanctions». In this regard, the legal nature of many coercive measures applied to offenders remains mysterious (for example, measures of influence applied to minors, imposing the obligation to compensate for the harm caused, etc.). All measures of coercion applied to a person in connection with the commission of an administrative offense are proposed to be divided into two large groups: 1) measures of administrative responsibility; 2) special educational events. The first is the goal of educating the offender through his punishment, and the second is exclusively educating a person in the spirit of respect for the rights, honor and dignity of other citizens, as well as precise and strict compliance with the requirements of national legislation. A critical analysis of the procedural norms of the Code of Administrative Offenses was carried out and ways of their solution in the modern conditions of the creation of the state were proposed.
