dc.description.abstractВ статье исследован международный обычай как источник международного права и, в частности, международного морского права. Автор проанализировал понятие, признаки и структуру международного обычая, а также рассмотрел проблемные аспекты образования и применения обычаев в международном праве, их разновидности. Отдельно рассмотрен вопрос международных морских обычаев, даны рекомендации в отношении различения морских обычаев и обыкновений.
dc.description.abstractIn the article the international law custom is studied as a source of international law and international maritime law particularly. The author analyzed the notion, characteristics and structure of international custom. She considered some problem aspects of international custom making and using and its types also. International custom is generally determined through two factors: the general practice of states and what states have accepted as law. Generally these two conditions must be fulfilled. Not only must the acts concerned amount to a settled practice, but the international law subjects (principally states) must express their will to considerate a customary role as a binding one. The need for such a belief, i.e., the existence of a subjective element, is implicit in the very notion of the opinio juris sive necessitatis. But this concept is discussed in the theory of so called instant custom. There are also questions about some international custom traits, such as: generality of the practice, content of the practice, duration of the practice, custom making subjects. The last tendency in international relations is to extend the international law making subjects list with international governmental organizations, international courts etc. The question of international maritime custom is considered apart, the recommendations of maritime customs and usages distinction are particularly made. The main difference between these categories is opinio juris that is present in international maritime custom and is absent in international maritime usage. One of the evidences of opinio juris presence may be an internal legislation of states.
