Анотація
Дана наукова стаття присвячена вивченню ролі адвоката в адміністративному провадженні, аналізу його процесуальних можливостей, ключових викликів та перспектив розвитку адвокатської діяльності в цій сфері. Особлива увага приділяється механізмам участі адвоката в адміністративному процесі, включаючи представництво інтересів клієнта, підготовку процесуальних документів, оскарження рішень адміністративних органів та контроль за їх виконанням. Досліджуються практичні аспекти реалізації правового захисту, проблеми правозастосування та основні труднощів, з якими стикаються адвокати.
В статті аналізуються сучасні виклики адвокатської діяльності в адміністративному провадженні, зокрема, правова невизначеність, бюрократичні перешкоди, відсутність рівності сторін та корупційні ризики. Важливе місце відведено оцінці впливу цифровізації, реформ законодавства та підвищення професійної компетентності адвокатів на ефективність правового захисту особи.
Доведено, що адвокат відіграє важливу роль в адміністративному провадженні, забезпечуючи ефективний правовий захист громадян та юридичних осіб у їхніх взаєминах з державними органами. Вдосконалення ж участі адвоката в адміністративному провадженні потребує комплексних змін як на рівні законодавства, так і в аспекті технологічного та інституційного розвитку.
Результати дослідження можуть бути корисними для науковців, практикуючих адвокатів, суддів та законотворців, які працюють у сфері адміністративного права та судочинства. Висвітлюються стратегічні підходи до вдосконалення законодавства, підвищення гарантій незалежності адвокатської діяльності, розширення процесуальних можливостей адвокатів та впровадження сучасних технологій у практику адміністративного провадження.
This scientific article is devoted to the study of the role of a lawyer in administrative proceedings, the analysis of his procedural capabilities, key challenges and prospects for the development of legal activity in this area. Particular attention is paid to the mechanisms of participation of a lawyer in the administrative process, including representation of the client's interests, preparation of procedural documents, appeal against decisions of administrative bodies and control over their implementation. The practical aspects of the implementation of legal protection, problems of law enforcement and the main difficulties faced by lawyers are investigated. The article analyzes the current challenges of advocacy in administrative proceedings, in particular, legal uncertainty, bureaucratic obstacles, lack of equality of parties and corruption risks. An important place is given to assessing the impact of digitalization, legislative reforms and increasing the professional competence of lawyers on the effectiveness of legal protection of individuals. It has been proven that a lawyer plays an important role in administrative proceedings, ensuring effective legal protection of citizens and legal entities in their relations with state bodies. Improving the participation of a lawyer in administrative proceedings requires comprehensive changes both at the legislative level and in terms of technological and institutional development. The research findings may be useful for practicing lawyers, scholars, judges, and lawmakers working in the field of administrative law and justice. Strategic approaches to improving legislation, strengthening guarantees of independence for lawyers, expanding their procedural capabilities, and implementing modern technologies in administrative proceedings practice are discussed.
