dc.description.abstractСтаття присвячена дослідженню умов правомірності заподіяння шкоди правопорушнику в процесі запобігання, припинення та захисту співробітників правоохоронних органів, військовослужбовців від суспільно небезпечних посягань (здійсненні службових владних повноважень). Автором визначається послідовна система таких умов, і характеризуються їх певні особливості. На підставі проведеного дослідження робиться висновок про доцільність існування кримінальної відповідальності за перевищення допустимих меж щодо застосування сили при здійсненні службових владних повноважень.uk
dc.description.abstractСтатья посвящена исследованию условий правомерности причинения вреда правонарушителю в процессе предотвращения, прекращения и защиты сотрудников правоохранительных органов, военнослужащих от общественно опасных посягательств (осуществлении служебных властных полномочий). Автором определяется последовательная система таких условий, и характеризуются их определенные особенности. На основании проведенного исследования делается вывод о целесообразности существования уголовной ответственности за превышение допустимых пределов по применению силы при осуществлении служебных властных полномочий.uk
dc.description.abstractThe article investigates the conditions of legitimacy to infliction of harm to the offender in the process of prevention, cessation and protection by law enforcement officers, military personnel from socially dangerous encroachment with the use of physical force, special means and firearms (the exercise of the official overbearing powers). The author determines the consistent system of conditions of legitimacy by infliction of harm in the process of exercise of the official overbearing powers and divides these conditions into two groups: 1) The conditions relating to encroachment - conditions that establish the circumstances that enable specifically authorized person of the state to perform act aimed at causing harm to the offender. These include: a) social danger of the encroachment; b) reality of the encroachment. 2) The conditions relating to counteraction of the encroachment (prevention, cessation and protection against it) - conditions that establish the legitimacy of actions specifically authorized person of the state, aimed at causing harm to the offender in the exercise of the official overbearing powers. These include: a) the legitimacy of the object of protection; b) forced causing harm only offender; c) the timeliness of application of the impact funds; d) the legitimacy of limits of application of the impact funds. The article reveals the content and characteristics of each of these conditions legitimacy. For example, the legitimacy of the object of protection means that protection in the exercise of official authority should be relative to state and public interests, life and health, rights and freedoms, property specifically authorized person of the state or others. Based on this study an author concludes that the exercise of the official overbearing powers is the self-dependent circumstance, which precluding criminality of act. Also an author confirms advisability the existence of an self-dependent kind of criminal responsibility associated with excess of permissible limits on the application of force in the exercise of the official overbearing powers.uk
