dc.description.abstractТенденції, що намітилися за останнє десятиліття в технологічному розвитку низки галузей, претендують на те, щоб позначити перехід до принципово нового етапу в науково-технологічному розвитку. Зростання обчислювальної потужності комп'ютерів, їх активне застосування в біології та медицині, розвиток 3D-друку і робототехніки, успіхи вчених у роботі з матерією на нанорівні є достатніми підставами для того, щоб дійти висновку про новий етап у розвитку міжгалузевих та міждисциплінарних досліджень. У зв’язку з тим, що право має відображати ці зміни, у людини виникають нові права, яких не було раніше. Тобто права людини еволюціонують разом із суспільством. Важливо зазначити, що всі історичні зміни, які проходять у державі, безпосередньо мають відображатися у такий категорії, як «права людини». Отже поглиблене дослідження правової природи поняття «новітні права людини» є актуальним питанням з різними складовими. В зазначеному питанні можливо окреслити певні особливості, які характерні новітнім правам людини та надають змогу відмежувати їх від перших трьох поколінь прав людини. По-перше, вони виникли за результатом науково-технічного прогресу, відкриттям у медицині, біології, тощо. По-друге, новітні права людини та їх закріплення у Основному законі держави призведе до певних трансформаційних змін права як суспільного інституту. Як слідство, може зазнати суттєвих змін ціннісно-правова сфера. Усі зміни вплинуть на майбутнє людства, тому потребують продовження поглиблене вивчення новітніх прав людини та їх впливу на сучасну цивілізацію. Легітимність прав особистості та заявлені серед них пріоритети визначаються контекстом певного історичного етапу розвитку. Оскільки люди у різних частинах планети та в різні часи відстоюють та поважають ті чи інші права людини відповідно до різних процедур, то ці питання повністю залежать від часу, місця, обставин та інших чинників. При цьому взаємовідносини держави та особистості в історичній ґенезі через покоління прав людини показують, що в міру розвитку прав особистості спостерігається зміна їх кількості та поширення на різні сфери суспільного та соціального життя. Про це переконливо свідчить і поява третього та четвертого поколінь прав людини. З іншого боку, гармонійний розвиток особистості можливий лише у правовій демократичній державі та в розвиненому громадянському суспільстві.uk_UA
dc.description.abstractThe trends that have emerged over the last decade in the technological development of industries claim to mark the transition to a new stage in scientific and technological development. The growth of computing power of computers, their active use in biology and medicine, the development of 3D printing and robotics, the successes of scientists in working with matter at the nano-level are sufficient grounds for concluding that a new stage in the development of interdisciplinary and interdisciplinary research is forming. Due to the fact that the law must reflect the changes that are happening around us, a person has new rights that did not exist before. That is, human rights evolve along with society. It is important to note that all historical changes taking place in the state should be directly reflected in such a category as «human rights». Thus, it is possible to outline certain features that are characteristic of the latest human rights and make it possible to distinguish them from the first three human rights. First, they arose as a result of scientific and technical progress, discoveries in medicine, biology, etc. Secondly, the newest human rights and their consolidation in the Constitution will lead to certain transformational changes in law as a social institution. As a consequence, moral values and legislation in the state may undergo significant changes. All changes will affect the future of humanity; therefore, it is necessary to continue in-depth study of the latest human rights The legitimacy of human rights and the manifestation of their priority rights are determined by the context of a certain historical stage of development. Because people in different parts of the planet and at different times defend and respect certain human rights. At the same time, the relationship between the state and the individual in the historical context through the generations of human rights shows that as individual rights develop, there is a change in their number and spread to various spheres of public and social life. The appearance of the third and fourth generation of human rights also proves this convincingly. On the other hand, the harmonious development of the individual is possible only in a legal democratic state and in a developed civil society.
