Анотація
Статтю присвячено дослідженню інститута відшкодування моральної (немайнової) шкоди у зарубіжних країнах. У результаті аналізу відповідних правових норм та судової практики виявлено
проблеми та особливості відшкодування моральної шкоди у Німеччині, Франції, Англії та США. Практика Европейского Суду з прав людини дозволила виявити концептуальні основи відшкодування
моральної шкоди та можливість запровадження основних ідей до чинного законодавства України.
The article is devoted to the study of the institute of moral (nonpecuniary) reparation foreign countries. As a result of the analysis of relevant legal rules and jurisprudence, problems and peculiarities of non-pecuniary damage in Germany, France, England and the United States were identified. The practice of the European Court of Human Rights has enabled us to identify the conceptual foundations for nonpecuniary damage and the possibility of introducing key ideas into current Ukrainian legislation.
