dc.description.abstractСтаття присвячена аналізу сучасного стану та перспективам застосування інформаційних технологій в процедурі банкрутства. Виявлено, що останнє десятиліття Україна впевнено крокувала до диджиталізації всіх сфер життєдіяльності, хоча перші спроби впровадження інформаційних технологій в судову та правоохоронну систему були ще в минулому столітті. Зміни торкнулися розподілу справ між суддями, процедури розгляду справ, проведення відеоконференцій, викладення судових актів у відкритий доступ, реєстрації відкриття проваджень та інших питань. Пандемія COVID-19 прискорила цей процес та виявила нові перспективні напрями застосування інформаційних технологій. В статті обґрунтовано, що всі інформаційні технології, що застосовуються в конкурсному провадженні в господарських судах, можуть бути умовно поділені на дві групи: ті, які використовуються для всіх або більшості видів та форм проваджень, а також ті, які використовуються лише при провадженні у справах про банкрутство (неплатоспроможність). До перших можна віднести практично всі модулі Єдиної судової інформаційно-телекомунікаційної системи, електронні реєстри (адвокатів, юридичних осіб, фізичних осіб-підприємців та громадських формувань, прав власності на нерухоме майно та інші). До другої: Єдиний реєстр боржників, оприлюднення відомостей про справи про банкрутство. Аналіз сучасного стану застосування інформаційних технологій у сфері конкурсного провадження виявляє численні недоліки, неврахування важливих елементів, які впливають на ефективну роботу модулів і програм. Щодо перспектив застосування інформаційних технологій в процедурі банкрутства в статті запропоновано: 1) вдосконалити модуль автоматизованої системи з відбору кандидатів на призначення арбітражного керуючого у справах про банкрутство шляхом доповнення його критеріями територіальності, спеціалізації, досвіду кандидата та складності справи; 2) максимально автоматизувати процес прийняття рішення про застосування того чи іншого заходу відновлення платоспроможності боржника; 3) синхронізувати між собою нові та існуючі системи, реєстри та модулі, які необхідні для ефективного проведення конкурсного провадження; 4) при створенні та вдосконаленні інформаційних технологій в процедурі банкрутства приділяти значну увагу захисту персональних даних.uk_UA
dc.description.abstractThe article is devoted to the analysis of the current state and prospects of the use of information technologies in the bankruptcy procedure. It was revealed that over the past decade, Ukraine has been confidently moving towards the digitization in the many fields, although the first attempts to introduce information technologies into the judicial and law enforcement system were in the last century. The changes affected the mechanism of distribution of cases between judges, the procedure for considering cases, conducting video conferences, publishing court acts in open access, registering the opening of proceedings and other issues. The COVID-19 pandemic accelerated this process and revealed new promising areas of information technology application. The article substantiates that all information technologies used in bankruptcy proceedings in economic courts can be conditionally divided into two groups: those that are used for all or most types and forms of proceedings on the one hand, as well as those that are used only in the conduct of cases about bankruptcy (insolvency) on the other hand. The first group includes almost all modules of the Unified Judicial Information and Telecommunication System, electronic registers (for attorneys, for legal entities, individual entrepreneurs and public organizations, for real estate ownership rights, and others). The second group is represented by the Unified register of debtors, publication of information on bankruptcy cases. Analysis of the current state of application of information technologies in the field of competitive proceedings reveals numerous shortcomings, neglect of important elements that affect the effective operation of modules and programs. There are the next proposals regarding the prospects for the use of information technologies in the bankruptcy procedure in the article: 1) to improve the module of the automated system for selecting candidates for the appointment of an bankruptcy administrator in bankruptcy cases by supplementing it with criteria of territoriality, specialization, experience of the candidate and complexity of the case; 2) to maximally automate the decision-making process on the application of this or that measure to restore the debtor’s solvency; 3) to synchronize new and existing systems, registers and modules necessary for the effective conduct of tender proceedings; 4) to pay significant attention to the protection of personal data implementing and improving information technologies in the bankruptcy procedure.
