    Promoting the rule of law through free trade agreements: the case of public procurement reform in Ukraine

    The history of the U. S. state-sponsored and private agencies' ambitious effort to reform substantive legislation, judicial systems and legal education in Asia, Africa and South America dates back to the Law and Development Movement of the 1960s. Since that time donor institutions worldwide have been promoting what T. Carothers (2010) called the standard "RoL reform menu", offering the reforms of substantive laws; law-related institutions and "increasing government's compliance with the law". As the"Community, based on the rule o f law (RoL)", the EU is not an exception to this rule. While the EU emphasizes the RoL in its Enlargement Strategy and actively promotes it to third states, the EU's RoL promotion activities are broadly criticized in scholarship. The first deficiency of the EU Enlargement Policy and external RoL promotion is the lack of clear standards, leading to the fact that the Candidate countries and Neighbours have to "comply with the unknown". Second, the EU tends not to go beyond the 'menu', enshrined by Carothers. Finally, the set of the legal and implementing instruments the Union uses to promote the RoL barely changes over time, notwithstanding the external challenges.

    The eu’s development policy: legal foundations and the prospects of evoluion

    Following the 2013 Revolution of Dignity and the signature of the ambitious EU-Ukraine Association Agreement, the EU plays ever growing role in supporting political and socio-economic development in Ukraine. For the time being, such support is being exercised on two legal bases: the support to the implementation of the Association Agreement (the application unilateral financial and technical assistance instruments) and 2014 State-Building Contract for Ukraine that combines macro-financial credits and direct budget support instruments (whose total value accounts for 11.2 billion euro).

    The future of the Eastern Partnership: “Building a shared European home”

    The year 2014 became a turning point for the history of the EU Eastern Partnership (EaP), marked by the signing of the Association Agreements with three EaP states and a conflict in Ukraine. In view of the above, current research focuses on assessing the feasibility of currently discussed scenarios of the EaP future, based on the assessment of the EU’s foreign policy successes and challenges in Eastern Neighborhood. EU’s internal issues, re-emerging geo-strategic threats and domestic challenges in the EaP states are analyzed. The considered scenarios include the EU’s acceptance of status quo in the region, taking a stronger stance to the integration of Ukraine, Moldova and Georgia, as well as building “a shared European home” by promoting rapproachement with Russia. The single scenario for the EU’s policy in the EaP states is suggested, and it is explained why the EU will try to “build a shared European home”.

    Еnhanced conditionality and monitoring clauses in the EU-Ukraine Association Agreement

    The EU-Ukraine Association Agreement was signed between the EU and its Member States, of the one part, and Ukraine, of the other part to create a political and economic association between the Parties. The scope of the Agreement provides for its three basic features, namely comprehensiveness, complexity and conditionality.
