Сопільняк В.Ю. Теоретико-методологічні та прикладні засади застосування практики ЄСПЛ у рішеннях національних судів. – Кваліфікаційна наукова праця на правах рукопису. Дисертація на здобуття наукового ступеня доктора філософії у галузі знань 08 «Право» зі спеціальності 081 «Право». – Одеський національний університет імені І.І. Мечникова, Одеса, 2026. Дисертація присвячена комплексному дослідженню теоретико-методологічних та прикладних засад застосування практики Європейського суду з прав людини у національних судових рішеннях України. У роботі здійснено системний аналіз процесу інтеграції конвенційних стандартів у національне правосуддя крізь призму еволюції праворозуміння, суддівського тлумачення та трансформації ролі судової практики в системі джерел права. У межах дослідження проаналізовано правову природу феномену «джерело права» з урахуванням сучасних доктринальних підходів, а також розкрито особливості практики ЄСПЛ як одного з елементів цієї системи. Обґрунтовано, що практика ЄСПЛ посідає специфічне місце серед джерел права, поєднуючи інтерпретаційну та нормативно-регулятивну функції, а її юридична сила зумовлена як міжнародно-правовими зобов’язаннями держави, так і роллю Суду у формуванні стандартів тлумачення Конвенції як «живого інструменту». Здійснено теоретико-методологічне обґрунтування місця Конвенції про захист прав людини і основоположних свобод та практики ЄСПЛ у правовій системі України в контексті доктрини джерел права. Доведено, що Конвенція та практика Суду утворюють єдиний нормативно-інтерпретаційний комплекс, який має пріоритетне значення у сфері захисту прав людини та визначає зміст і межі суддівського тлумачення відповідних правових норм у національному судочинстві. Обґрунтовано, що практика ЄСПЛ не може розглядатися виключно як допоміжний або факультативний аргумент у судовому рішенні. У роботі запропоновано нову наукову характеристику тлумачної діяльності Європейського суду з прав людини як «екзегетичної», яка полягає у глибокому й комплексному аналізі положень Конвенції у кожній конкретній справі. Така діяльність поєднує формальне тлумачення тексту Конвенції з інтерпретацією змісту її норм у світлі сучасних соціальних, правових і моральних реалій, унаслідок чого формується «живе право» Конвенції. Доведено, що ефективність реалізації її положень безпосередньо залежить від здатності національних судів коректно ідентифікувати, інтерпретувати та застосовувати сформовані Судом правові позиції у конкретному фактичному й правовому контексті. У дисертації здійснено аналіз судової практики України щодо застосування рішень ЄСПЛ судами першої, апеляційної та касаційної інстанцій, на підставі якого виокремлено основні етапи сприйняття та використання практики Суду на національному рівні. Запропоновано періодизацію становлення відповідної практики, що включає етап формального ознайомлення (1997–2006), для якого характерним було спорадичне застосування Конвенції та практики Суду, які сприймалися як додаткове нормативне джерело, подібне до національного закону; дискурсивний етап (2006–2017), під час якого активізувалися дискусії щодо ролі судового прецеденту в системі джерел права, та почалося поступове подолання формалізму у застосуванні практики ЄСПЛ у національних судових рішеннях та все більше практикуючих юристів звертали увагу на потенціал прецедентного права ЄСПЛ як інструменту розвитку правової системи; та етап імітаційного європеїзму (з 2017), який характеризується з одного боку поступовим зростанням розуміння національними судами природи прецеденту ЄСПЛ як джерела права та демонстрацією більш якісного використання аргументів Суду, а з іншого – різким зростанням кількості посилань на практику ЄСПЛ без належної методологічної глибини її застосування. Саме ця диспропорція між кількістю та якістю зумовила назву останнього етапу. Встановлено, що однією з ключових проблем сучасного правозастосування є відсутність уніфікованих методологічних підходів до роботи з прецедентною практикою ЄСПЛ, що зумовлює ризики формального, декларативного або селективного цитування рішень Суду. Обґрунтовано, що сам по собі обов’язок судів керуватися практикою ЄСПЛ не гарантує її якісної інтеграції у судову аргументацію за відсутності чітких методичних орієнтирів. Окрему увагу у роботі приділено аналізу ролі Верховного Суду у сучасному механізмі застосування практики ЄСПЛ. Доведено, що Верховний Суд виконує системоутворюючу функцію у забезпеченні єдності судової практики та використання стандартів ЄСПЛ у національному правосудді, однак ефективність цієї функції залежить від надання Верховним Судом чітких методологічних орієнтирів, здатних забезпечити їх послідовне сприйняття судами нижчих інстанцій. У межах дослідження сформульовано авторське визначення «релевантності у судовому тлумаченні», під якою запропоновано розуміти ступінь змістової та смислової спорідненості між правовим стандартом, сформульованим ЄСПЛ, та предметом національного судового розгляду, що зумовлює доцільність, обґрунтованість та значимість застосування такого стандарту. Релевантність у судовому тлумаченні розглядається як результат аналітичної оцінки співвідношення правових позицій Суду з предметом спору, метою захисту відповідного права та місцем конкретного рішення у загальній системі практики ЄСПЛ. Основним науковим результатом дисертації є розроблення та обґрунтування принципу концентрованої релевантності як методологічного підходу до застосування практики ЄСПЛ у національному судовому рішенні. Запропонований принцип полягає у відборі та використанні лише тих правових позицій Суду, які є необхідними й достатніми для вирішення конкретної правової проблеми, та ґрунтується на поєднанні трьох взаємопов’язаних складових: предметної (відповідність правової позиції предмету спору), функціональної (узгодженість із метою захисту конкретного права) та системної (відповідність загальній логіці та еволюції практики ЄСПЛ). Доведено, що застосування цього принципу дозволяє підвищити якість судового мотивування та уникнути надмірного або випадкового цитування прецедентів. Подальшим розвитком зазначеного підходу стало формулювання методики застосування практики ЄСПЛ у національному судовому рішенні, який відображає послідовність інтелектуальних операцій судді – від правової ідентифікації спору та формулювання правової проблеми до виокремлення ratio decidendi релевантних рішень Суду та його аргументованого відтворення у мотивувальній частині судового акту. Доведено універсальний характер цього алгоритму та можливість його застосування незалежно від галузі судочинства чи статті Конвенції. Окрему увагу у роботі приділено аналізу перспектив використання цифрових технологій і штучного інтелекту для підвищення ефективності застосування практики ЄСПЛ у національному судочинстві. Обґрунтовано, що такі інструменти можуть виступати допоміжним засобом суддівської діяльності, сприяючи оперативному пошуку та систематизації релевантної практики, за умови збереження провідної ролі судді у процесі тлумачення права та прийняття правового рішення. Практичне значення результатів дослідження полягає у можливості використання сформульованих у роботі висновків, принципів і алгоритмів у діяльності судів усіх інстанцій, у процесі підготовки та підвищення кваліфікації суддів, а також при вдосконаленні національного процесуального законодавства в частині регламентації методології застосування практики ЄСПЛ. Їх застосування сприятиме більш якісному мотивуванню судових рішень, підвищенню рівня правової визначеності, зменшенню кількості скасованих судових актів судами вищих інстанцій, а також зниженню кількості звернень громадян до Європейського суду з прав людини у зв’язку з належним забезпеченням конвенційних прав на національному рівні.

The dissertation is devoted to a comprehensive study of the theoretical, methodological and applied foundations of the application of the case-law of the European Court of Human Rights in national judicial decisions of Ukraine. The research provides a systematic analysis of the process of integration of Convention standards into national justice through the prism of the evolution of legal understanding, judicial interpretation and the transformation of the role of judicial practice within the system of sources of law. Within the scope of the research, the legal nature of the phenomenon of “source of law” is analysed with due regard to contemporary doctrinal approaches, and the specific features of the case-law of the European Court of Human Rights as one of the elements of this system are revealed. It is substantiated that the case-law of the Court occupies a specific place among the sources of law, combining interpretative and normative-regulatory functions, and that its legal force is determined both by the State’s international legal obligations and by the role of the Court in shaping standards for the interpretation of the Convention as a “living instrument”. A theoretical and methodological substantiation of the place of the Convention for the Protection of Human Rights and Fundamental Freedoms and the case-law of the European Court of Human Rights within the legal system of Ukraine is provided, in particular in the context of the doctrine of sources of law. It is demonstrated that the Convention and the case-law of the Court form a single normative and interpretative complex which has priority significance in the field of human rights protection and determines the content and limits of judicial interpretation of the relevant legal norms in national adjudication. It is substantiated that the case-law of the European Court of Human Rights cannot be regarded exclusively as an auxiliary or optional argument in a judicial decision. The dissertation proposes a new scientific characterisation of the interpretative activity of the European Court of Human Rights as **“exegetical”**, which consists in a deep and comprehensive analysis of the provisions of the Convention in each individual case. Such activity combines formal interpretation of the text of the Convention with interpretation of the content of its norms in the light of contemporary social, legal and moral realities, as a result of which the “living law” of the Convention is formed. It is proven that the effectiveness of the implementation of its provisions directly depends on the ability of national courts to correctly identify, interpret and apply the legal positions developed by the Court in a specific factual and legal context. The dissertation analyses the judicial practice of Ukraine regarding the application of judgments of the European Court of Human Rights by courts of first instance, appellate courts and courts of cassation, on the basis of which the main stages of perception and use of the Court’s case-law at the national level are identified. A periodisation of the development of such practice is proposed, which includes the stage of formal familiarisation (1997–2006), characterised by sporadic application of the Convention and the Court’s case-law, perceived as an additional normative source similar to national legislation; the discursive stage (2006–2017), during which discussions on the role of judicial precedent in the system of sources of law intensified and a gradual overcoming of formalism in the application of the case-law of the European Court of Human Rights in national judicial decisions began, while an increasing number of practising lawyers paid attention to the potential of ECtHR precedent as an instrument for the development of the legal system; and the stage of imitative Europeanisation (since 2017), which is characterised, on the one hand, by a gradual increase in the understanding by national courts of the nature of ECtHR precedent as a source of law and the demonstration of more qualitative use of the Court’s arguments, and, on the other hand, by a sharp increase in the number of references to the ECtHR case-law without sufficient methodological depth of its application. It is precisely this disproportion between quantity and quality that determined the designation of the latter stage. It is established that one of the key problems of contemporary legal practice is the absence of unified methodological approaches to working with the precedent-based case-law of the European Court of Human Rights, which results in the risks of formal, declarative or selective citation of the Court’s judgments. It is substantiated that the mere obligation of courts to be guided by the ECtHR case-law does not guarantee its qualitative integration into judicial reasoning in the absence of clear methodological guidelines. Special attention in the dissertation is paid to the analysis of the role of the Supreme Court in the modern mechanism of applying the case-law of the European Court of Human Rights. It is shown that the Supreme Court performs a system-forming function in ensuring the unity of judicial practice and the use of ECtHR standards in national justice; however, the effectiveness of this function depends on the provision by the Supreme Court of clear methodological guidelines capable of ensuring their consistent perception by lower courts. Within the research, an authorial definition of “relevance in judicial interpretation” is formulated, which is understood as the degree of substantive and semantic affinity between a legal standard formulated by the European Court of Human Rights and the subject matter of national judicial proceedings, which determines the expediency, justification and significance of applying such a standard. Relevance in judicial interpretation is considered as the result of an analytical assessment of the correlation between the Court’s legal positions, the subject of the dispute, the purpose of protecting the relevant right, and the place of a particular judgment within the overall system of the ECtHR case-law. The principal scientific result of the dissertation is the development and substantiation of the principle of “concentrated relevance” as a methodological approach for the application of the ECtHR case-law in national judicial decisions. The proposed principle consists in selecting and using only those legal positions of the Court that are necessary and sufficient to resolve a specific legal problem, and is based on the combination of three interrelated components: substantive (correspondence of the legal position to the subject matter of the dispute), functional (consistency with the purpose of protecting a specific right), and systemic (correspondence to the general logic and evolution of the ECtHR case-law). It is proven that the application of this principle makes it possible to improve the quality of judicial reasoning and to avoid excessive or random citation of precedents. A further development of this approach is the formulation of an algorithm for the application of the ECtHR case-law in national judicial decisions, which reflects the sequence of intellectual operations performed by a judge – from identifying the dispute and formulating the legal problem to extracting the ratio decidendi of relevant judgments of the Court and its reasoned reproduction in the reasoning part of a judicial decision. The universal nature of this algorithm and the possibility of its application regardless of the branch of law or the article of the Convention are substantiated. Special attention in the dissertation is also paid to the analysis of the prospects for the use of digital technologies and artificial intelligence to improve the effectiveness of applying the ECtHR case-law in national adjudication. It is substantiated that such tools may act as auxiliary means of judicial activity, facilitating the prompt search and systematisation of relevant case-law, provided that the leading role of the judge in the process of legal interpretation and decision-making is preserved. The practical significance of the research results lies in the possibility of using the conclusions, principles and algorithms formulated in the dissertation in the activities of courts of all instances, in the process of training and advanced professional development of judges, as well as in improving national procedural legislation in terms of regulating the methodology for applying the ECtHR case-law. Their application will contribute to higher-quality reasoning of judicial decisions, an increase in the level of legal certainty, a reduction in the number of judicial acts overturned by higher courts, and a decrease in the number of applications lodged by individuals with the European Court of Human Rights due to the proper protection of Convention rights at the national level.
