Внесено пропозицію про визнання захворювання професійним у випадку зараження будь-якого працівника коронавірусом COVID-19. Розглянуті питання про виокремлення такого елемента об’єктивної сторони складу злочину, як порушення вимог санітарних правил і гігієнічних нормативів. Викладено пропозиції щодо конкретизації такого суспільно небезпечного діяння, як порушення вимог законодавчих та інших нормативно-правових актів про гігієну праці та виробничу санітарію шляхом внесення змін до ч. 1 ст. 271 Кримінального кодексу України.Проведен анализ производственного травматизма и профессиональной заболеваемости в Украине, а также эффективность превентивного потенциала уголовно-правовых норм о преступлениях против безопасности производства. Внесено предложение о признании заболевания профессиональным в случае заражения любого работника коронавирусом COVID-19. Рассмотрены вопросы о выделении такого элемента объективной стороны состава преступления, как нарушение требований санитарных правил и гигиенических нормативов. Изложены предложения по конкретизации такого общественно опасного деяния, как нарушение требований законодательных и других нормативно-правовых актов о гигиене труда и производственной санитарии путем внесения изменений в ч. 1 ст. 271 Уголовного кодекса Украины.The article considers the issue of isolating such an element of the objective side of the crime as violation of sanitary rules and hygiene standards. It turns out that this makes sense not only in light of the specifics of the Criminal Code of Ukraine, but also in light of practical use to prevent occupational diseases, curb the spread of coronavirus COVID-19 and other infectious diseases, while protecting workers and society as a whole. Given the recommendations of the International Labor Organization to include in the list of occupations at high risk of coronavirus disease as a professional not only medical workersin direct contact with patients, but also medical technicians, pharmacists, firefighters, journalists, shopkeepers, gas stations, etc., it is proposed to recognize this occupational disease regardless of the sector of the national economy and the profession of the victim. This will allow the law enforcer to avoid mistakes in resolving the issue of distinguishing between violations of sanitary rules and hygienic standards in the course of work from the general rule enshrined in Art. Art. 325 of the Criminal code of Ukraine. Particular attention is paid to the socio-legal nature of the analyzed type of criminal encroachments and the establishment of the place of regulations on liability for them in the criminal legislation of Ukraine. Ways to improve the criminal law in terms of combating crimes against industrialsafety, in particular, violations ofsanitary rules and hygiene standards. Depending on the features of the object of legal protection, the objective side of the crime, it is proposed to amend Part 1 of Art. 271 of the Criminal Code of Ukraine and to state it in the following wording: «1.
