Під таємницею розуміємо факт, інформацією про який володіє обмежене коло осіб, та який є невідомим для широкого кола суб’єктів правовідносин. Таємниця усиновлення має наступні ознаки: вона виникає з приводу специфічного юридичного факту – усиновлення; стає відомою вузькому колу осіб, як правило членам сім’ї та визначеному колу службових осіб, тобто наявний специфічний суб’єктний склад її носіїв; вона стосується внутрішнього життя сім’ї і не може бути здобуттям громадськості, а тому охороняється мірами державного примусу; має комплексний характер, тобто для службових осіб вона є професійною, службовою таємницею, а для членів сім’ї – особистою; вона стосується внутрішнього життя сім’ї і не може бути здобуттям громадськості, а тому охороняється заходами державного примусу; сама інформація що становить таємницю усиновлення, є специфічною (зміна прізвища, по батькові, місця проживання, дати народження тощо). Таємницю усиновлення слід розглядати в двох аспектах: таємниця від суспільства, і таємниця від самого усиновлюваного. Думаємо доцільно було б в законодавстві закріпити вік з якого дитині можуть розголошуватись відомості про її усиновлення – 18 років, бо в цей період дитина є більш зрілою для адекватної реакції на таку інформацію. Суб’єкти, що забезпечують таємницю усиновлення: службові особи, сторонні особи та усиновлювачі. Діюче законодавство чітко зазначає яка ж інформація становить таємницю усиновлення: інформація про зміну запису про матір та батька; інформація про зміну відомостей про місце народження та дату народження дитини; інформація про зміну прізвища, імені та по батькові особи, яка усиновлена.This article aims to explore the mystery of adoption and its legal protection. A secret we understand as a fact about which information is available to a limited number of persons, and which is unknown to a wide range of subjects of legal relations. The mystery of adoption has the following characteristics: it arises due to a specific legal fact – adoption; becomes known to a narrow circle of people, usually family members and a certain circle of officials, that is, there is a specific subject composition of its carriers; it concerns the internal life of the family and cannot be acquired by the public, and therefore is protected by measures of state coercion; it has a complex nature, that is, for officials it is a professional, official secret, and for family members – a personal secret; it concerns the internal life of the family and cannot be acquired by the public, and therefore is protected by measures of state coercion; the very information that constitutes the secret of adoption is specific (change of surname, patronymic, place of residence, date of birth, etc.). The secret of adoption should be considered in two aspects: – a secret from society, and a secret from the adoptee himself. We think it would be expedient to establish in the legislation the age at which information about the child’s adoption can be disclosed – 18 years, because in this period the child is more mature for an adequate reaction to such information. Entities ensuring the secrecy of adoption: officials, third parties and adopters.
