dc.description.abstractУ статті проаналізовано стан та перспективи зближення транспортного законодавства України з Acquis Communautaire Європейського Союзу в транспортній галуззі. Реалізація Угоди про Асоціацію між Україною, з однієї сторони, та Європейським Союзом, Європейським співтовариством з атомної енергії і їхніми державами-членами, з іншої сторони, зокрема, запровадження поглибленої і всеохоплюючої зони вільної торгівлі, має короткочасний та відстрочений у часі вплив на розвиток транспортної політики та транспортного законодавства України. Цей вплив обумовлений, по-перше, значним збільшенням взаємного товарообігу, обсягів вантажних та пасажирських перевезень, по-друге, формуванням правових, економічних організаційних, технічних, соціальних, безпекових умов для включення України до спільного європейського транспортного простору. Реалізація цих амбітних планів пов’язана, в тому числі, з адаптацією українського транспортного законодавства до правових стандартів Європейського Союзу. Ефективність модернізації транспортного законодавства Україна залежить від чіткого розуміння структури сучасного механізму правового регулювання транспортних відносин на регіональному (європейському) рівні, а також співвідношення Acquis Communautaire Європейського Союзу в транспортній галузі з системою джерел українського транспортного законодавства. Отримання Україною статусу кандидата на членство в Європейському Союзі остаточно визначило стратегічні напрями розвитку національної транспортної політики і транспортного законодавства. Доводиться що системна модернізація транспортного законодавства України повинна вестись з урахуванням стратегій, стандартів і практик Європейського Союзу в транспортній галузі. На основі аналізу співвідношення транспортного законодавства України з транспортним законодавством держав-членів Європейського Союзу, надано прогноз розвитку відповідного правового поля в Україні та визначені поточні маркери його модернізації.uk_UA
dc.description.abstractThe article analyzes the state and prospects of convergence of transport legislation of Ukraine with the Acquis Сommunautaire of the European Union in the transport sector. The implementation of the Association Agreement between Ukraine, on the one hand, and the European Union, the European Atomic Energy Community and their member states, on the other hand, as well as the introduction of a deep and comprehensive free trade zone, has a short- and long-term influence on the development of transport policy and transport legislation of Ukraine. This influence is explained, firstly, by a significant increase in mutual trade, the volume of cargo and passenger transportation, and secondly, by the formation of legal, economic, organizational, technical, social and security conditions for the inclusion of Ukraine in the common European transport space. The implementation of these ambitious plans is connected, among other things, with the adaptation of Ukrainian transport legislation to European Union legal standarts. The effectiveness of the modernization of transport legislation in Ukraine depends on a clear understanding of the structure of the modern mechanism of legal regulation of transport relations at the regional (European) level, as well as the correlation of the Acquis Communautaire of the European Union in the transport sector with the system of sources of Ukrainian transport legislation. Obtaining the status of a candidate member of the European Union by Ukraine finally determined the strategic directions for the development of national transport policy and transport legislation. It is proved that the systemic modernization of the transport policy and transport legislation of Ukraine should be carried out considering the strategies, standards and practices of the European Union in the transport sector. Based on the analysis of the relationship between the transport legislation of Ukraine and the transport legislation of the European Union member states, a forecast of the development of the relevant legal field in Ukraine is provided and current markers of its modernization are determined.
