dc.description.abstractThe theoretical investigation of the essential features of the legal status of the intervener with one of litigants at the commercial court procedure has been fulfilled. The analyze of the legal works on the issues of the definition of intervener, kinds of interveners, criteria of classifications of interveners as well as specific features of the interveners has been kept. The idea that a participation of the intervener with one of litigants at the court trial is stipulated by their legal nexus was substantiated. The rights and obligations of the interveners at the commercial court procedure as well as issues of the compensation of court fees and legal costs of the interveners have been analyzed. The proposals for the improvement of the rules of the Code of Commercial Procedure related to the issues mentioned above have been made.uk
dc.description.abstractВ статье проводится теоретическое исследование особенностей правового статуса третьих лиц, не заявляющих самостоятельные требования относительно предмета спора, в хозяйственном процессе. Осуществляется анализ юридической литературы по исследованию понятия третьих лиц, их видов, критериев их классификации, характерных черт. Обосновано, что участие третьего лица без самостоятельных требований обусловлено правовой связью третьего лица и лица, на стороне которого вступает в дело такое третье лицо. Проанализированы права и обязанности третьих лиц в хозяйственном процессе Украины. Исследованы вопросы возмещения судебных расходов, возникших в связи с участием третьих лиц в процессе. Предложено усовершенствовать положения Хозяйственного процессуального кодекса Украины по рассмотренным вопросамuk
