Філософсько-правове дослідження сучасної правотворчості

Abstract

У статті досліджено особливості і тенденції розвитку сучасної правотворчості в умовах трансформації суспільства.

Аргументировано показано, что правотворчество, - это специфическая форма деятельности органов государственной власти (как правило), которая заключается в издании, изменении или отмене правовых норм и имеет целью регулирование общественных отношений путем нормативного закрепления степеней свободы и справедливости. Определены особенности и тенденции развития правотворческой деятельности и дальнейшего совершенствования законодательства Украины. Авторам показано, что с целью развития современной правотворчества в Украине, адаптации законов и других нормативно-правовых актов с европейским законодательствам необходимо разработать механизм обеспечения выполнения этой работы, выработать единые правила европейского законодательства.

It is well-reasoned that lawmaking is a specific form of authorities ’activities (as a rule), that involves publication, changing or canceling legal norms and is purposed to regulate social. relations by normative fixing of freedom and justice measures. The peculiarities and tendencies of lawmaking development and its further improvement in Ukraine are defined. The author has shown that in order to develop modern lawmaking system in Ukraine, to adapt laws and all the regulatory and legal framework up to the European legislation it is crucial to work out the mechanism of security and execution, as well as common rules of European lawmaking. Currently, the majority of citizens Ukraine increases feelings of suspicion and criticism in the perception of reality cynicism in relation to the ideals of excessive skepticism and distrust. This a against the backdrop of spreading the culture of consumption and greed motivation, changing idea about the limits of acceptable in social and political behavior, the rules and norms of coexistence. in society, also against the background of legal literacy and not legal nihilism. For the latter, the problem is the practical absence of an integrated system of legal education that leads to low les. of legal culture of society in general.
