Порівняльно-правовий аналіз норм про необхідну оборону у кримінальному законодавстві англо-американських країн

Abstract

Стаття присвячена дослідженню кримінально- правового закріплення норм про необхідну оборону у законодавстві основних країн англо-американської правової системи. Проводиться порівняльно-правовий аналіз цих норм за певними критеріями (найменування, місцезнаходження, форма здійснення, система об'єктів захисту, правова підстава) та робляться узагальнені висновки.

Статья посвящена исследованию уголовно-правового закрепления норм о необходимой обороне в законодательстве основных стран англо-американской правовой системы. Проводится сравнительно-правовой анализ этих норм по определенным критериям (наименование, местонахождение, форма осуществления, система объектов защиты, правовое основание) и делаются обобщающие выводы.

The article investigates the criminal law norms about defense (necessary defense) in the criminal legislation of English-American countries (Great Britain, the United States of America (in the Model Penal Code and Penal Code of the states), Australia, Canada). The author conducted a comparative legal analysis of fixation the defense as lawful act in these countries on the following criteria: name a lawful act; the location lawful act; a form oflawful act; system objects of the protection; the legal basis of application lawful act. Based on conducted comparative legal analysis, the author makes the certain findings for example, about that: a) the concept of “necessary defense” in the English-American legal system in general is formulated as a “defense”, which is divided into appropriate subgroups - protecting themselves; protection of another (third) person; protection of own movable and immovable property (including peaceable possession); protection of movable and immovable property of another (third) person; b) a form of necessary defense in the criminal legislation of the English-American legal system is characterized through the “use of force (physical force)” and must include a reference to the criteria of “immediately necessary” and to the criteria of reasonableness protective actions (using force), for example, “in reasonable limits”, “reasonably believes”, “reasonable grounds”, “reasonable answer” etc.; c) legal basis of application defense (necessary defense) in the criminal legislation of the English-American legal system in general can protrude a “use of unlawful (illegal) force”. These resumptive findings form the progressive foreign experience, which can be used to form norms about the necessary defense in Ukrainian criminal legislation.
