Дослідження зосереджено на виокремленні критеріїв оцінного судження та розмежуванні його з фактичним твердженням, що є актуальними для проведення семантико-текстуальної лінгвістичної експертизи. Визначення оцінного судження пов’язано з наявністю у висловлюванні негативної або позитивної інформації, але потребує чітких критеріїв оцінності. Законодавчі акти не дають можливості однозначного тлумачення понять оцінного судження та фактичного твердження і не корелюють з лінгвістичною теорією. Суперечності між поглядами лінгвістів-експертів і лінгвістівнауковців на цю проблему не дають змогу виробити єдиний принцип визначення оцінних суджень. Теоретичним підґрунтям наукової розвідки слугували праці українських дослідників у галузі юридичної лінгвістики та рекомендації практичного характеру в галузі лінгвістичної експертизи. У дослідженні з’ясовано сутнісні характеристики категорії оцінки у мовознавстві та на матеріалі експертних висновків проаналізовано основні шляхи розмежування оцінних суджень і фактичних тверджень на лексичному і граматичному рівнях. Отримані результати прислужаться у проведенні лінгвістичних семантикотекстуальних експертиз з визначення оцінних суджень.
The research focuses on distinguishing the criteria of evaluative judgment and distinguishing it from the factual statement that is relevant for semantic-textual linguistic examination. The definition of evaluative judgment is related to the presence of negative or positive information in the statement, but requires clear evaluation criteria. Legislation does not allow unambiguous interpretation of the concepts of evaluative judgment and factual assertion and does not correlate with linguistic theory. Contradictions between the views of expert linguists and linguistic scholars on this issue do not allow to develop a single principle for determining evaluative judgments. The purpose of the study is to determine the criteria for distinguishing between factual statement and evaluative judgment, relevant to semantic-textual linguistic research. The aim was to solve the following tasks: to outline the problems of semantic-textual expert research, to characterize the category of assessment from a linguistic perspective; definition of evaluative judgment and factual statement; formation of criteria for distinguishing between evaluative judgments and factual statements. The theoretical basis of scientific research was the work of Ukrainian researchers in the field of legal linguistics and recommendations of a practical nature in the field of linguistic examination. The study clarifies the essential characteristics of the category of evaluation in linguistics and on the basis of expert opinions analyzes the main ways to distinguish between evaluative judgments and factual statements at the lexical and grammatical levels. The obtained results will be used in conducting linguistic semantic-textual examinations to determine evaluative judgments. Linguistic semantic-textual examination of the definition of evaluative judgments should take into account both the theoretical provisions of legal linguistics and practical recommendations for experts. In the absence of an approved methodology for analyzing such statements, it is advisable to develop an appropriate algorithm that covers five stages and is based on linguocognitive, linguopragmatic and linguistic approaches to the analysis of the assessment category. At these stages it is necessary to determine the lexical meaning of the components of expression; identify direct and figurative word usage; characterize the objective content of the statement; to find out the communicative intention of the speaker; determine the type of statement – evaluative judgment or factual statement. Prospects for the study are to develop evaluation criteria relevant to semantictextual examination.
