Анотація
Статтю присвячено здійсненню аналізу політико-правових ідей в Україні у ХVІ–ХVІІ ст. у творчості
таких видатних постатей вітчизняної культури, як С. Оріховський, І. Вишенський, В. Суразький, Г. Сковорода, П. Могила.
Дослідження політико-правових ідей в Україні у зазначений період пов’язано з питанням взаємозв’язку та співвідношення між теоретичним надбаннями західноєвропейського Відродження та потужним пластом духовної культури України, а також між подіями західноєвропейської Реформації та реформаційним рухом на українських землях.
Метою дослідження є визначення характерних особливостей трансформації європейських ідей Відродження та Реформації в українських реаліях.
За допомогою системного підходу досліджено українські політико-правові ідеї у контексті західноєвропейських культурних, релігійних і політичних подій. Доведено, що формування власної політико-правової думки відбувається під культурним, релігійним і політичним впливом західноєвропейських подій, пов’язаних із Відродженням і Реформацією. Підкреслено взаємозв’язок богословської риторики
з формуванням політико-правової думки в Україні у ХVІ–ХVІІ ст.
Виявлено специфіку формування політико-правових ідей в Україні, яка виявляється в тому, що
загальнодержавні, суспільні та політичні проблеми були напряму пов’язані з церквою; від церковної
політики залежав варіант суспільно-політичного розвитку українського суспільства; трансформація
ідей західноєвропейської Реформації в умовах тогочасної України вплинула на розгортання політичної
боротьби за незалежність серед різних верств населення, на розвиток культури і релігійного життя
українського суспільства.
Обґрунтовано необхідність подальшого поглибленого історико-правового дослідження формування
вчень про державу і право в Україні.
Запропоновано нові підходи до методології пізнання української історико-правової дійсності. Звернено увагу на важливу роль у пізнавальному процесі державно-правової реальності філософсько-правовій рефлексії, котра дозволяє досліджувати державу і право у різноманітних зв’язках із політичними, релігійними, культурними явищами та процесами у суспільстві. Поєднуючи доступні принципи
та засоби пізнання, метод філософсько-правової рефлексії дозволяє суб’єкту правосвідомості здійснювати філософський самоаналіз, теоретичний аналіз (рефлексію) правової реальності у контексті інших
сфер суспільного життя.
The article is devoted to the analysis of political and legal ideas in Ukraine in the ХVІ–ХVІІ centuries in the works of such prominent figures of national cultre as S. Orikhovsky, I. Vyshensky, V. Surazky, G. Skovoroda, P. Mohyla. The study of political and legal ideas in Ukraine during this period is related to the question of the relationship and correlation between the theoretical achievements of the Western European Renaissance and a significant layer of the spiritual culture of Ukraine, as well as between the events of the Western European Reformation and the reformation movement in the Ukrainian lands. The aim of the study is to determine the characteristic features of the transformation of the European ideas of the Renaissance and Reformation in the Ukrainian realities. Author uses the systematic approach to study Ukrainian political and legal ideas in the context of Western European cultural, religious and political events. It has been proved that the formation of political and legal knowledge takes place under the cultural, religious and political influence of Western European events associated with the Renaissance and Reformation. The author highlights the interrelation of theological rhetoric with the formation of political and legal thought in Ukraine in the ХVІ–ХVІІ centuries. This article emphasizes the features of the formation of political and legal ideas in Ukraine. The main feature is that national, social, and political problems were directly related to the church; the version of the socio-political development of Ukrainian society depended on church policy; the transformation of the ideas of the Western European Reformation in the conditions of the then Ukraine influenced the deployment of the political struggle for independence among various strata of the population, the development of the culture and religious life of Ukrainian society. The necessity of further in-depth historical and legal research of the formation of doctrines about state and law in Ukraine has been substantiated. The author proposes new approaches to the methodology of cognition of the Ukrainian historical and legal reality. Attention is drawn to the important role in the cognitive process of the legal reality of philosophical and legal reflection, which allows studying the state and law in various connections with political, religious, cultural phenomena and processes in society. Combining the available principles and means of cognition, the method of philosophical and legal reflection allows the subject of legal consciousness to carry out philosophical introspection, theoretical analysis (reflection) of legal reality in the context of other spheres of public life.
