Abstract: Стаття присвячена питанням складу й структури органів, які мають здійснювати перевірку кандидатів на посади суддів або ж чинних суддів на доброчесність і дотримання професійної етики. Визнання доброчесності окремою конституційною вимогою для суддів / кандидатів на посаду судді стало одним із найголовніших досягнень конституційно-судової реформи 2016 року. Проте на практиці виявилось досить складно забезпечити реалізацію цієї вимоги через зовнішні й внутрішні чинники. Черговий етап судової реформи, який триває нині, саме й пов’язаний із питаннями визначення порядку формування органу суддівського врядування – Вищої ради правосуддя, яка після проходження процедури на перевірку доброчесності власних членів вже своєю чергою має забезпечити доброчесність усього суддівського корпусу. У контексті гостроти й системних криз, пов’язаних із функціонуванням і діяльністю судової влади в Україні, актуальним видається дослідження саме питань суб’єктного складу органів суддівського врядування, від яких прямо залежить відповідність всього суддівського корпусу до вимог доброчесності. Здійснення такого дослідження базується на порівняльному аналізі загальновизнаних європейських стандартів формування суддівських рад / комісій, досвіді окремих зарубіжних країн та особливих рекомендацій міжнародних інституцій, вироблених для так званих молодих демократій. У такому аспекті автором обґрунтовується позиція щодо необхідності здійснення певного відступу від найголовнішого принципу незалежності суддівського врядування, на якому базується судова влада в розвинутих демократичних державах, а саме «суддів обирають самі судді» або ж «суддів судять самі судді». Такий принцип, який є єдино прийнятним для «сталих демократій», виявився згубним для держав, в яких основи демократії, відповідальної влади й прозорої діяльності державних посадовців (насамперед суддів) ще не стали аксіомою. Як наслідок, проявились такі проблеми, як корпоративізм, покривання своїх своїми, відсутність довіри до рішень, прийнятих відповідними органами щодо суддівських кадрів. Досвід України, Молдови, Грузії та інших країн засвідчив, що оптимальним шляхом подолання окреслених проблем є широке залучення до оцінювання суддів / кандидатів на предмет їх доброчесності й професійної етики представників громадськості. Саме тому автором запропоновано істотне посилення ролі Громадської ради доброчесності в розв’язанні відповідних питань, наділення її правом виносити щодо цих питань остаточні й обов’язкові висновки, перехід від роботи на громадських засадах до постійної оплатної форми роботи з встановленням принципів повноти й обґрунтованості власних висновків із поєднанням відповідальності за їх зміст.
The article deals with the composition and structure of the bodies that should inspect candidates for the positions of judges or current judges for integrity and observance of professional ethics. Recognition of integrity as a separate constitutional requirement for judges / candidates for the position of a judge has become one of the most important achievements of the 2016 constitutional and judicial reform. However, in practice it turned out to be quite difficult to ensure the implementation of this requirement due to external and internal factors. The next stage of judicial reform, which continues today, is related to determining the procedure for forming a body of judicial governance – the High Council of Justice, which after passing the procedure to verify the integrity of its members must in turn ensure the integrity of the judiciary. In the context of the severity and systemic crises associated with the functioning and activity of the judiciary in Ukraine, it is relevant to study the issues of the subjective composition of the judiciary, which directly affects the compliance of the entire judiciary with the requirements of integrity. The implementation of the relevant study is based on a comparative analysis of generally accepted European standards for the formation of relevant judicial councils / commissions, the experience of individual foreign countries and special recommendations of international institutions developed for the so-called young democracies. In this aspect, the author argues that it is necessary to deviate from the most important principle of judicial independence, on which the judiciary in developed democracies is based, namely: “judges are elected by judges themselves” or “judges are judged by judges themselves”. Such a principle, which is the only one acceptable to “sustainable democracies”, proved to be detrimental to states in which the foundations of democracy, responsible government and transparent activities of public officials (especially judges) have not yet become an axiom. As a result, there were such problems as corporatism, self-coverage, lack of confidence in the decisions taken by the relevant bodies regarding the judiciary. The experience of Ukraine, Moldova, Georgia and other countries has shown that the best way to overcome these problems is to involve members of the public in the evaluation of judges / candidates for their integrity and professional ethics. That is why the author proposes a significant strengthening of the role of the Public Integrity Council in resolving relevant issues, giving it the right to make final and binding conclusions on these issues, the transition from community service to a permanent form of work with the principles of completeness and validity of its own conclusions. a combination of responsibility for their content.
