Статья посвящена исследованию проблем, связанных с определением особенностей перевода как объекта авторского договора. Автором исследуются вопросы о признаках перевода как производного литературного произведения. Для определения понятия перевода и его видов рассмотрены отдельные точки зрения ученых-цивилистов, являющихся специалистами в данной сфере. В настоящей статье рассмотрен вопрос о необходимости соблюдения личных неимущественных прав автора первоначального произведения, в частности, права на защиту репутации автора и его произведения.
This article addresses the legal nature of translations as derived literary works. The article attempts to define the signs of translations as derived literary works, and the concept of translations. The study of the main problems related to the legal understanding of translations concluded that this type of derivative literary works has such signs as - creative nature of the translator's work, individuality, novelty of the form. An independent concept of translation as a derivative of a literary work is proposed. Certain types of translations are described as authorized, intermediate, subscript. It has been established that when creating a translation as an object of copyright, it is necessary to obtain the appropriate permission of the author of the original work. In the absence of such permission, the translation will be considered as a counterfeit work, therefore, it cannot be recognized as an object of copyright. Also, it is determined that the translation of the original artistic work should not distort its essence, content. Otherwise, the personal non-property right of the author of the original work will be violated.
