Анотація
У статті розглянуті питання, пов’язані з визначенням правової природи ритуальних
послуг. Встановлено, що ритуальні послуги мають свою історію розвитку, що пов’язано зі
зміною уявлення людей про смерть й ставлення до неї. Насамперед, ритуальні послуги ґрунтуються на тих або інших обрядах різних народів. Водночас існують такі способи поховання,
як поховання і кремація. Відповідно, від вибору способу поховання залежить вибір комплексу
ритуальних послуг. Ритуальні послуги займають своє місце в системі видів послуг. В Україні
відносини з надання ритуальних послуг регулюються Законом України «Про поховання й похоронну справу», а також підзаконними нормативно-правовими актами, що визначають порядок діяльності ритуальних служб,в тарифів на ритуальні послуги. У Законі України «Про
поховання й похоронну справу» визначається, що ритуальні послуги − це послуги, пов’язані з
організацією й похованням та облаштованістю місця поховання. З цього визначення випливає, що до комплексу ритуальних послуг включений фактично весь спектр дій із поховання
померлого. Встановлено, що ритуальні послуги мають ознаки, які властиві всім видам послуг.
При цьому акцентовано, що конститутивні ознаки послуг (нематеріальний результат, синхронність споживання, незбереження) характерні для ритуальних послуг з особливим змістом. Також порушується проблема, що стосується реалізації одного з основних принципів
діяльності в області поховання − принципу гідного ставлення до тіла померлого. До основних суб’єктів, які мають повною мірою дотримуватися цього принципу, належать особи, на
яких покладено обов’язок із виконання волі померлого щодо свого похорону. У разі відсутності
такого волевиявлення, виконання дій із дотримання зазначеного принципу покладається на
осіб, встановлених законом.
The article deals with issues related to the definition of the legal nature of funeral services. It has been established that funeral services have their own history of development, which is associated with a change in people’s perception of death and attitudes towards it. First of all, ritual services are based on those or other rites of various nations. Currently, there are ways of burial as burial and cremation. Accordingly, the choice of the funeral services complex depends on the choice of the method of burial. Funeral services take their place in the system of types of services. In Ukraine, relations in the provision of funeral services are regulated by the Law of Ukraine “On burial and funeral business”, as well as by-laws and regulations that determine the order of activity of funeral services, the establishment of tariffs for funeral services. The Law of Ukraine “On Burial and Funeral Business” determines that funeral services are services related to the organization and burial and arrangement of the burial site. From this definition it follows that the range of funeral services includes virtually the entire range of actions for the burial of the deceased. It is established that funeral services have signs that are inherent in all types of services. At the same time, attention was drawn to the fact that constitutive features of services (non-substantive result, synchronism of consumption, nonconservation) are characteristic of funeral services with special content. Also raises the problem relating to the implementation of one of the basic principles of activity in the field of burial - the principle of a decent attitude to the body of the deceased. The main subjects who must fully adhere to this principle are the persons charged with the obligation to fulfill the will of the deceased regarding their burial. In the absence of such a declaration of will, the implementation of actions to comply with this principle is assigned to persons established by law.
