Анотація
Стаття присвячена дослідженню питань, пов'язаних з визначенням сутності послуг хостингу. Акцентовано увагу на
технічні особливості послуг хостингу, оскільки саме вони й визначають не тільки юридичні ознаки даних послуг, але й
впливають на критерії якості послуг хостингу. Відзначено, що через установлення ряду технічних властивостей послуг
хостингу, можливо виділити юридичні особливості цих послуг. Дано оцінку терміну «хост» [host -господар], що з
технічної сторони означає будь-який комп'ютер, що має повний двосторонній доступ до інших комп'ютерів ви Інтернеті.
Визначено, що хостинг можна розглядати як послугу з надання ресурсів на сервері для розміщення інформації в мережі
Інтернет. Аргументовано, що технічні особливості послуг хостингу істотно впливають на визначення правової сутності
даних послуг. З'ясовано, що послугам хостингу властиві загальні юридичні ознаки послуг як цивільно-правової категорії.
Зокрема, послуги хостинга, так само як і більшість послуг нематеріальні. Однак, деякі загальні ознаки послугам хостингу
не властиві. Так, ознака «синхронності» надання й споживання до послуг хостингу не застосуємо. Це пов'язано, знову
таки, з технічними особливостями послуг хостингу. Крім того, аргументовано, що загальні ознаки послуг як несохранність
і неможливість виконавця гарантувати результат послуги, також не прийнятні для послуг хостингу. У статті звертається
увага на те, що хостинг має свої види, вибір одного або декількох видів впливає на правильності визначення предмета
договору на надання послуг хостингу. Крім того, від правильності вибору « хостинг-пакета» залежить і якість, надаваної
послуги.
The article is devoted to the study of issues related to the definition of the essence of hosting services. Attention is focused on the technical features of hosting services, since it is they who determine not only the legal attributes of these services, but also affect the quality criteria of hosting services. It was noted that through the establishment of a number of technical properties of hosting services, it is possible to distinguish the legal features of these services. An assessment of the term “host” [host – host], which technically means any computer that has full two-way access to other computers on the Internet, is given. It was determined that hosting can be considered as a service of providing resources on a server for hosting information on the Internet. It is argued that the technical features of hosting services significantly affect the definition of the legal nature of these services. It has been found that hosting services share common legal characteristics of services as a civil legal category. In particular, hosting services, as well as most services are not embodied. However, some common features of hosting services are not inherent. So, the sign of “synchronization” of provision and consumption to hosting services is not applicable. This is due, again, to the technical features of the hosting services. In addition, it is argued that the general features of the services such as nonconservation and the inability of the contractor to guarantee the result of the service are also not acceptable for hosting services. The article draws attention to the fact that hosting has its own types, the choice of one or several types affects the correctness of the definition of the subject of the contract for the provision of hosting services. In addition, the quality of the service provided depends on the correctness of the choice of the “hosting package”.
