Стаття присвячена дослідженню принципів договірного права України. У статті досліджуються існуючі підходи до визначення загальноприйнятої системи принципів договірного права. У статті вирішуються питання щодо визначення окремих дискусійних понять у сфері застосування принципів договірного права.
Статья посвящена исследованию принципов договорного права Украины. В статье исследуются существующие подходы к определению общепринятой системы принципов договорного права. В статье решаются вопросы определения отдельных дискуссионных понятий в сфере применения принципов договорного права.
The article is devoted to the research of the principles of the contract law of Ukraine. There are investigated in the article the existing approaches to definition of the standard system of the principles of the contract law. In the article the issues of definition of separate debatable concepts of scope of the principles of the contract law are resolved. It is paid attention in the article that to define the most precisely the concept “the principles of the contract law”, it is necessary to consider the legal categories “the principles of law” and “the principles of civil law”. Considering features of the contract law institute, it is offered to mark out the characterizing signs of the principles of the contract law. It is also offered to define the legal category “the principles of the contract law” proceeding from their main features. In the article the main approaches to the definition of the list of the principles of the contract law are analyzed. Also it is paid the attention in the article to the expediency of creation of the special system of the principles of the contract law. The separate types of the principles of the contract law are analyzed in the article.
