Анотація
Питання розвитку комерційного процесуального права України освітлено у звіті про досвід Польщі, Німеччини, Франції та інших європейських країн. Виявлено проблеми правового регулювання представництва в суді, класу-дій та реалізації мирних угод в комерційній процедурі. Автор пропонує деякі заходи для вирішення зазначених вище питань. Скасування монополії адвокатів, а також додаткові гарантії щодо процесуального статусу законних опікунів та представників за дорученням або договором обґрунтовуються автором. Було підтримано розширення прав неурядових організацій, об'єднань компаній та корпорацій на представництво їх членів. Автор доводить обґрунтування можливості ухвалення мирної угоди під час судового перегляду судових рішень (апеляції, касації тощо).
The issue of the development of commercial procedural law of Ukraine is enlightened in the report concerning the experience of Poland, Germany, France and other European countries. The problems of the legal regulations of representation in the court, class-actions and realization of the amicable agreements in the commercial procedure have been elicited. The author proposes some measures in order to resolve the issues stated above. The cancellation of the monopoly of barristers as well as additional guaranties for procedural status of the legal guardians and representatives by the power of attorney or agreement are grounded by the author. The expansion of rights of the non-governmental organizations, associations of companies and corporations as to represent their members was supported. The author proves rationale for the possibility to approve the amicable agreement in the course of judicial review of the court decisions (appellation, cassation etc.).
