Анотація
У статті досліджуються міжнародні економічні договори та їх значення в
правовому регулюванні зовнішньоекономічної діяльності. З урахуванням існуючих наукових праць
визначено поняття та види міжнародних економічних договорів. Окрема увага акцентується на
міжнародних економічних договорах, укладених під егідою Європейського Союзу та Світової
організації торгівлі, та значенні цих договорів для України.
В статье исследуются международные экономические договоры и их значение в правовом регулировании внешнеэкономической деятельности. С учётом существующих научных трудов определяются понятие и виды международных экономических договоров. Отдельное внимание акцентируется на международных экономических договорах, заключенных под эгидой Европейского Союза и Всемирной организации торговли, и значении этих договоров для Украины.
The article examines the international economic agreements and their significance in the legal regulation of foreign economic activity. The concept and types of international economic agreements are defined as taking into account existing scientific papers. The problems associated with the bilateral agreements on trade and economic cooperation, mutual promotion and protection of investments, avoidance of double taxation in which Ukraine is a member are analyzed. Special attention is paid to the international economic agreements concluded under the auspices of the EU and the WTO and the value of these contracts for Ukraine. The current state of legal enforcement in this area requires the perception of international agreements not only as the main sources of modern regulation of international relations at the level of classical public international law, but also as a dynamic regulator of relations between economic entities at the level of international economic law, commercial law, transport and other branches of law. Conducted in the analysis proves the existence of a complex system of international economic agreements signed by Ukraine in various fields foreign economic relations and the many problems associated with the use, interpretation and implementation of these agreements. The current state of legal enforcement in this area requires the perception of international agreements not only as the main sources of modern regulation of international relations at the level of classical public international law, but also as a dynamic regulator of relations between economic operators at the level of international economic law, commercial law, transport and other areas of law. Especially noticeable is this duality in the context of European integration of Ukraine through Ukraine Association Agreement with the EU, which is a benchmark for social and economic reforms and change principles regulation of foreign economic activity Ukraine.
