Саморегулiвнi органiзацiї у системi регуляторних органiв будiвельної галузi України

Abstract

В статті розкрито поняття, правовий статус саморегулівних організацій в Україні, їх сутність, правова основа діяльності, компетенція. Акцентована увага на основних моделях саморегулювання у сфері будівництва: делегованому, добровільному та змішаному. Наведено перелік саморегулівних організацій України. Розкриті особливості прояву деяких їх функцій.

В статье раскрыто понятие, правовой статус саморегулируемых организаций в Украине, их сущность, правовая основа деятельности, компетенция. Акцентировано внимание на основных моделях саморегулирования в сфере строительства: делегированоv, добровольном и смешанном. Приведен перечень саморегулируемых организаций Украины. Раскрыты особенности проявления некоторых их функций.

Article devoted to the study of some aspects related to the concept, the legal status of self-regulatory organizations in Ukraine, the legal regulation of their activity and competence. The attention is focused on the basic models of self-regulation in the construction industry: delegation, voluntary and mixed. The list of self-regulating organizations of Ukraine. The features of manifestation of certain features on the example of the Ukrainian public organization «Guild of designers in construction», the All-Ukrainian public organization «Association of experts of the construction industry»; «Guild of construction engineering supervision engineers architectural objects» Ukrainian public organization. The analysis of the legislation on the definition of the terms of reference of these organizations in the field of construction activities in the context of international experience and the possibility of using this experience in Ukraine. Indicated on the imperfection of normative securing competencies of self-regulatory organizations. The author ‘s definition of the investigated categories. It is noted that in conditions of radical changes and transformations of the Ukrainian society is actual content of the new content of state regulation of the Institute in the context of the decentralization of power, which will increase the level of protection of the rights, freedoms and interests of individuals in the field of construction activities, to strengthen the authority of the state in the internal and external level. The solution to this extremely important issue is largely dependent on effective legislation.
