| Abstract: | Стаття розкриває результати теоретичного дослідження ідей історичної школи права в становленні юридичної герменевтики. Особлива увага приділяється такому принципу історичної школи, як співвідношення між «постійним», «загальним» і «змінним», «релятивним» моментами у праві. Визначен пріоритет телеологічного розуміння історії права над органічним розумінням. The article exposes the results of theoretical research of ideas of historical school of law in becoming of legal hermeneutics. The special attention is spared to such principle of historical school, as a correlation of «permanent», «general» and «variable», «relative» moments in the law. The priority of the teleological understanding of history of law above the organic understanding is specified. |
